Palm Beach Dance Floor
DANCE FLOOR RENTAL AGREEMENT
This agreement is between Palm Beach Dance Floor (thereafter “supplier”) and Jenna Musolino (hereafter “Client”).
The Supplier shall provide a portable dance floor described below to the Client for an event (wedding) on February 18th April, 2023 at Lady Jean Ranch, located at 10333 Randolph Siding Road, Jupiter, from 5pm to 11pm.
PORTABLE DANCE FLOOR-INDOORS
The Supplier will provide a light wood portable dance floor 20 x 20 square feet, Wrapped with White Vinyl as displayed on our website. The dance floor installation will start between 10am and 3pm on the day of the event. The dance floor will be removed right after the event between 11pm and 12am. The supplier guarantees that all equipments, including portable dance floor shall be out of the building by 12am.
Site Preparation: Client agrees to have site cleaned and ready for delivery and installation or dismantled for pickup or the equipment, and also agrees to pay any additional charges for any delay incurred along with any labor charges resulting in client’s failure to do so.
Styling Fee: Styling is an additional fee of $125 per hour. Client acknowledges that any additional movement of the dance floor from one location to another one will incur additional charges (ie. moving dance floor from a ceremony set up to reception) and are not included in the delivery charge, and additional fees will be added as above. No one but Palm Beach Dance Floor and its contractors, is permitted to assemble or break down the dance floor panels.
Care of Dance Floor: In addition to its other obligations hereunder, Client shall pay a reasonable cleaning charge for items returned dirty, and protect the rented items from weather damage, breakage, unauthorized or improper use, theft or loss while in possession of client. The Client shall be charged $200 if any of the dance floor is damaged or excessively dirty (food, wine or drink spills).
Rental Order Client agrees that changes to numbers of dance panels cannot exceed a 10 percent decrease or increase to the original number. Client understands that Palm Beach Dance Floor makes no guarantee that there will be additional inventory available.
CHARGES AND EXTENSIONS
Client may request an extension of the dance floor rental period by contacting us in writing and obtaining our written approval beforehand. Client agrees to pay supplemental overtime rates at $125/hour while retaining possession of the dance floor. There must be a mutual agreement for the floor to be picked up at a later time than the original schedule and must be documented via email, otherwise this will constitute an extension on the lease and therefore charges of $125 per hour will incur. If dance floor is not returned within 24 hour of the “installation location” Palm Beach Dance Floor may consider such equipment stolen and shall take all steps necessary to recover said equipment, including charging the client at cost price thereof, and shall be due upon billing in addition to the rental charge.
Client agrees to pay 50% at the time of the booking as a deposit and the balance (50%) 3 days before the wedding.
Payment Schedule: The client agrees to pay Palm Beach Dance Floor the Rental Fees in accordance with the following schedule:
- An initial 50% of the total price (hereinafter “Retainer”) will be made upon signing of this Agreement to confirm the Reservation.
- The Retainer is non-refundable unless canceled 90 days or more before the event.
- The final balance is due 3 days prior to the event date.
- Additions and substitutions made 7 days prior to the event are subject to additional charges
- Items may be subtracted from an order, but no Rental Fee reduction or refunds are given if items are subtracted from an order 7 days or less from the Reservation Date.
- Rental Items (portable dance floor) are not officially reserved until Palm Beach Dance Floor receives a signed copy of this Agreement along with the the retainer (via email).
Form of Payment: Unless otherwise agreed to, payments to Palm Beach Dance Floor must be made in the form of Cash, Credit or Debit Card (accepted online), ACH Payment/Wire Transfer (inquire for Company wire transfer Information), or Check payable to: “Palm Beach Dance Floor ” and sent to 5331 Ellery Terrace, West Palm Beach, FL 33417
Returned Checks: There will be a $40.00 charge on any returned check for any reason.
Either party, without cause, may cancel this Agreement by delivering written notice to the other party.
Cancellation by Supplier: In addition to any other obligations set forth in this Agreement upon cancellation, if supplier terminates this Agreement, the supplier shall refund all fees to the Client, including security deposit.
Cancellation by Client: In addition to any other obligations set forth in this Agreement upon cancelation, if Client cancels this Agreement, the following terms apply:
- Cancelation made (based on days from the Reservation Load In Date, notice received between 9am-5pm CST):
- 90 days or more: Refund of any portion of total fees paid including the Retainer;
- 30 days or more: Refund of any portion of total fees paid above the Retainer;
- 29-8 days: No refund for any amounts paid;
- 7 days or less: Rental Fees are required be paid in full with no credit or refund
- For cancelations at any point, supplier’s Fees for Additional Services rendered through the date of cancelation will be due immediately, including but not limited to custom built items.
- If full balance has yet to be paid within 7 days, Supplier may charge the credit card on file.
All refunds shall be disbursed within 30 days of cancellation in the same form of payment, minus any transaction fees (4% credit card fee).
Rescheduling Reservation Dates
Clients are allowed to change venue on a case-by-case basis and are subject to a 20% rescheduling fee provided the dance floor is available for the new date, and there is no change on the location of the dance floor (i.e from indoors to outdoors). Parties will enter into a separate written agreement or modify this Agreement to reflect the Rescheduled Reservation Date. Signature of the Rescheduled Reservation Date contract voids the previous agreement.
Client acknowledges that the rental property is of a size, design, and capacity selected by Client, and that supplier disclaims all warranties express or implied with respect to the rental property, including any express or implied warranties as to condition, fitness for a particular purpose or durability. Palm Beach Dance Floor guarantees a safe, and quality dance floor.
Client agrees that photography/video of their event can be used for promotional purposes by Palm Beach Dance Floor.
WAIVER: Responsibility and Use & Disclaimer Warranties: Client is responsible for the use of the rented item (dance floor). Client assumes all risks inherent to the operation and use of rented items, and agree to assume the entire responsibility for the defense of, and to pay, indemnity and hold Palm Beach Dance Floor harmless from and hereby release Palm Beach Dance Floor from, all claims for damage to property or bodily injury (including death) resulting from the use, operation or possession of the items, whether or not it be claimed or found that such damage or injury resulted in whole or part from Palm Beach Dance Floor negligence, from the defective condition of the items, or any other cause.
CLIENTS HAVE READ AND AGREE TO THE ABOVE TERMS & CONDITIONS AND ACKNOWLEDGE RECEIPT.
